1. Educational purpose only
The website provides general information concerning retirement risks, rollover choices, annuities and life insurance. It does not provide individualized investment, legal, tax or accounting advice; create a fiduciary relationship; approve a product; establish suitability; or constitute an offer, binder, contract, policy, securities transaction or guarantee.
2. No client or professional relationship
Viewing the site, calling, completing the risk check or submitting an appointment request does not make you a client and does not obligate Insured Portfolios, LLC or any producer to meet with, advise, represent or accept you. A relationship concerning an insurance product arises only through appropriate disclosures, consumer-information gathering, producer licensing and appointment, carrier review and the applicable written documents.
3. Eligibility and lawful use
You must be legally capable of using the site and must use it only for lawful, personal or business inquiry purposes. You agree not to submit false contact information, impersonate another person, interfere with security, probe the site for vulnerabilities, introduce malicious code, scrape the site excessively, send spam, or use the site to violate another person’s rights.
4. Appointment requests
An appointment request is not an application, transaction instruction, transfer authorization or acceptance. Product consideration generally begins at $10,000, but carrier minimums and suitability requirements may be higher. Meeting a minimum does not guarantee eligibility, issuance or a recommendation. The company may decline or discontinue an inquiry at its discretion, subject to applicable law.
5. Accuracy and changes
Insured Portfolios, LLC seeks to provide useful information but does not warrant that every statement is complete, current or error-free. Insurance forms, rates, caps, participation rates, charges, ratings, tax rules and regulatory requirements can change. Carrier-approved materials and the issued policy or contract control. Website content may be revised, removed or suspended without notice.
6. Third-party content
The site may embed or link to third-party content, including video services. Third parties control their own content, availability, security, terms and privacy practices. A link or embed is provided for convenience and does not necessarily constitute endorsement of every third-party statement or offering.
7. Intellectual property
The site’s original layout, copy, graphics, marks and code are owned by or licensed to Insured Portfolios, LLC and are protected by applicable law. You may print a reasonable copy for personal evaluation. You may not reproduce, sell, modify, publish, frame, mirror, distribute or create a competing derivative site from the content without written permission, except as law expressly permits.
8. No warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security or results. Insured Portfolios, LLC does not guarantee that the website, form, email delivery, embedded video or server will be uninterrupted or free of harmful components.
9. Limitation of liability
To the fullest extent permitted by law, Insured Portfolios, LLC and its owners, producers, personnel and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost opportunities, lost data, lost profits or damages arising from reliance on website content, inability to use the site, a failed form submission, third-party content or unauthorized access. Nothing in these terms excludes liability that applicable law does not allow to be excluded.
10. Indemnity
You agree to indemnify and hold harmless Insured Portfolios, LLC and its personnel from claims and reasonable costs arising from your unlawful use of the site, your false submission, your violation of these terms or your infringement of another person’s rights, except to the extent prohibited by law.
11. Governing law and venue
These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, and applicable federal law. Subject to any mandatory law, disputes concerning website use shall be brought in a court of competent jurisdiction in Bernalillo County, New Mexico. This clause does not alter rights or procedures arising under a separate insurance contract or written agreement.
12. Severability and waiver
If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. Failure to enforce a provision once is not a permanent waiver.
